2024年にカンボジアで働くための外国人従業員枠の申請受付開始

カンボジア政府は外国人従業員枠の申請窓口を開設した。申請期限は2023年11月末まで。

カンボジアの労働法では、外国人従業員を雇用したい企業は、労働職業訓練省（MLVT）に外国人従業員枠を申請しなければならない。この割り当て制度により、カンボジア企業の従業員の10％のみが外国人となることができる。

これは以下のように計算される
・オフィス従業員 – 3パーセント
・熟練労働者：6パーセント
・非熟練労働者-1パーセント
・割り当てを受けた後、企業は外国人労働者集中管理システム（FWCMS）を通じて労働許可証を申請することができる。

企業は外国人従業員枠を超えることができるか？
カンボジアの企業は、以下の規則を守れば、外国人従業員枠を超えることが可能です。
・会社のオーナーまたは取締役は、雇用契約書を添付して、超過外国人従業員を雇用するための申請書をMLVTに提出
・FWCMSを通じて労働許可申請を行う
・労働許可手数料を支払う
・外国人従業員の有効なビザまたは滞在許可を取得
・外国人労働許可証の検査

カンボジアで事業を行う外国企業は、政府がJoint Foreign Workforce Inspection Team（JFWIT）を通じて外国人労働許可証の検査を行うことに留意すべきである。これは、通知の有無に関わらず実施される。

検査官は、以下のような重要書類のコピーを要求する
・会社の定款
・外国人従業員を雇用するための割当承認
・外国人従業員の労働契約書
・外国人従業員のパスポートおよびビザ
・外国人従業員の労働許可証と雇用カードなど
・カンボジアにおける労働許可証の取得方法

カンボジアでの就労を希望する外国人労働者は、有効なビジネスビザ（Eクラスビザ）が必要である。E-classビザは当初30日間有効です。このビザは、内務省（MoI）の移民局で申請することにより、一度に1ヶ月、3ヶ月、6ヶ月、最長1年の期間延長することができる。

6ヶ月と12ヶ月のビザは複数回のカンボジア入国を許可し、1ヶ月と3ヶ月のビザは1回の入国を許可する。
Eビザは、従業員の最寄りのカンボジア大使館およびプノンペン国際空港到着時に取得できる。

Eビザに加え、外国人労働者は労働許可証と雇用カードを取得しなければならない。
これは、MVLTを通じて申請する雇用者の責任です。

・登記住所
・会社印のある税務特許
・外国人従業員枠の承認
